By clicking on the Accept button at the bottom of these terms and conditions you agree to be legally bound by these terms and conditions as they may be modified and posted on the Website from time to time. Without prejudice to the above, by using or accessing the Website, you agree to be legally bound by these terms and conditions of use as they apply to your use of or access to the Website. If you do not wish to be bound by these terms and conditions then you may not use the Website.

Please note that the contents of the Website are aimed at users aged 14 and above, but you must be over 18 years to purchase the Products, using the payment method displayed on the Website.

We are entitled to refuse any order placed by you. If your order is accepted, we will confirm acceptance to you by online electronic means to the email address you have given us on ordering.

We reserve the right to alter, suspend or discontinue any aspect of the Website or the content or services available through it, including your access to it. Unless explicitly stated any new features including new content and/or the sale of new Products shall be subject to these terms and conditions.

You authorise us to use, store or otherwise process any personal information which relates to and identifies you, including but not limited to your name and address in accordance with the Privacy Policy.

The Website may contains a forum for discussions, a message or bulletin boards to which you may submit messages for publication and a product review option to coment on products available from this site. If you use the Discussion Forum, Bulletin Boards or Product Review you agree only to post, send and receive messages and material that are proper, comply with the requirements of the Website and relate to the Website. In particular, but not limited to the following, you agree when using the Discussion Forum and Bulletin Board, you will not:
1). Use any profanity or obscenities of any kind, even disguised with asterisks;
2). Make any personal attacks on other users or manufacturers.
3). Make any defamatory, obscene, indecent, lewd, pornographic, violent, abusive, insulting, threatening and harassing comments.
4). Stray from the discussion topic.
5). Impersonate other users or public figures. You may choose an appropriate nickname as long as your real name is used in the personal information field.
6). Falsify or delete any author attributions, legal or other proper notices or proper designations or labels of the origin or source of software or other material contained within files that are uploaded.
7). Post any third party copyright material. You should not upload files that contain software or other materials protected by copyright unless you own or control the rights in such software or have received the necessary consents to do the same.
8). Use over sized fonts, JavaScript, tables, headings or other advanced HTML commands. You may only bold or coloured fonts to emphasise your points.
9). Use the Discussion Forum, Bulletin Board or Product Review in connection with surveys, contests, pyramid schemes, chain letters, junk email, spamming or duplicating or unsolicited messages (commercial or otherwise).
10). Upload any files that contain viruses, Trojan horses, worms, time bombs, corrupted files or any other similar software or programs that may damage the operation of another computer or property of another.
11). Advertise or offer to sell or buy any goods or services for any business or private purposes.
12). Download any file posted by another user of the Discussion Forum, Bulletin Board or Product Review that you know, or should reasonably know, cannot be legally distributed in such manner.
13). Restrict or inhibit any other user from using and enjoying the Discussion Forum, Bulletin Board or Product Review.
14). Collect personal data about others (including email addresses).
15). Violate any applicable laws or regulations.

VAT Registration

Sherwood Models is registered in the UK for VAT. Our registration number is: GB 416 4735 52

VAT is included where applicable at the current rate of 17.5% (subject to change according to UK Government Policy) excluding printed material. VAT is deducted at the current rate from all orders meeting the required UK Customs & Excise criteria. VAT is a tax that is added to the net value of goods ie £100.00 plus VAT = £117.50. VAT is 7/47, not 17.5% of the order value. If £117.50 is your total order value then to calulate the VAT deducted = (117.50 x 7)/47 = £17.50. £17.50 should be deducted from your order value before adding postage and packaging.

Paying by Credit or Debit Card

You undertake that all details you provide to us for the purpose of purchasing the products will be correct, that the credit, debit or switch card which you use is your own and that there are sufficient funds or credit facilities to cover the cost of any goods or services. We reserve the right to obtain validation of your credit or debit or card details before providing you with the products. We do not process payment cards at the time of placing an order. Cards are processed when the goods are available for despatch only. Placing an order does not therefore automatically result in an immediate debit to your payment card.

Payment is accepted in UK Pounds Sterling only. Payment can be made online, by telephone, letter or fax using any valid credit or debit card. We currently do not charge a service fee for using this method of payment, however we reserve the right to do so at any future time. Please note the following before placing an order using a credit or debit card:

We only accept credit/debit cards that show the VISA or MASTERCARD logo. We do not accept payment by Switch, Solo or Electron.

Whether ordering online, by telephone or by post; please give your full name as detailed on your payment card, the address where your payment card is registered (normally your home address), together with your full postal/zip code. If you are using a business payment card, please supply the full name and address of the company including postal/zip code where the card is registered, together with the business telephone number.

Check the numbers on your card are the same as those given on the order form. We require the card number (long number on the front of the card) together with the commencement and expiry dates. We also require the digits (usually three) shown after your card number on the rear signature strip of the card together with the name of the issuing bank eg Lloyds TSB etc.

We are only authorised to send goods to the address where you have registered your payment card with your card provider. If you supply a different address to the one registered with your card providor, the transaction will be declined by our processing bank. Goods will not be supplied under any circumstance to a third party, or a third party address.

All payment card transactions are referred to our processing bank for authorisation before any goods are depatched.

Paying by Cheque or Postal Order

CASH SHOULD NOT BE SENT THROUGH THE POST UNDER ANY CIRCUMSTANCE!

Payment is accepted in pounds sterling only. If placing an order by post, please note the following points before doing so:

Please print clearly in capital letters your full name and postal address including post code on your order, and on the reverse side of your cheque/postal order.

Please ensure that all cheques/postal orders are crossed and made payable to Sherwood Models.

Please write your cheque guarantee card number on the reverse side of your cheque together with the cheque guarantee card expiry date and your address as detailed above.

Please ensure the sum payable written on your cheque in letters is the same as the amount payable in numbers. If they are not the same your cheque will be rejected by our bank and it will be returned to you.
Please remember to include the relevant postage and packaging charge.

Outstanding Goods Policy

Any item(s) we are unable to supply at the time of dispatch will be cancelled unless we contact you to inform you that the goods have been placed on back order.

New Release Policy

All new release for the catalogue year are marked accordingly where possible (E&OE).They are only guidelines as lengthy delays can and do occur. Orders received for new items will be presented for payment only when the goods are in stock. In the event of any new release being oversold, we reserve the right to supply goods to customers upon order of receipt of their initial order i.e. a first come first served basis.

Pricing Policy

All prices shown include Value Added Tax (VAT) at the current rate. Every effort is made to ensure the advertised price is correct on this website (E&OE). We reserve the right to alter, ammend or correct prices at our discretion. If this situation should arise, we will endeavour to notify customers before dispatching goods. We further reserve the absolute right to withdraw from sale, any item offered on our website without prior notice or reason being given. We also reserve the right to refrain from the supply of goods to a customer placing an order without giving reason.

Testing Policy

Please note that we will endeavour (where practicable) to test certain goods prior to dispatch. This policy may result in some damage to packaging. Items that are shrink wrapped or blister packed may not be so tested as it will cause damage to the packaging particularly if required for a present.

Trade Descriptions

Most items offered for sale on this site are suitable for adult collectors/modellers only due to fine intricate detail or sophisticated working parts.Customers MUST seek advice from ourselves before ordering any item(s) for a child or young person to check its suitability.

Whilst every efforthas been made (E&OE) to ensure accuracy of descriptions, scales/gauges, colours, measurements, release dates, voltages etc, those indicated are approximate and given in good faith from information supplied to ourselves. The goods dispatched may therefore differ from those shown on our site, and are thereby subject to alteration.

Due to the vast amount of goods offered on this site, it is not possible to upgrade the site on a regular basis. Some items will therefore sell out quickly as they may be in short supply. We therefore advise potential customers to contact us prior to placing an order to ascertain current availability.

Sherwood Models use the services and secure server provided by one of the UK top sites. As this service is not provided by Sherwood Models, we cannot assume any responsibility (or part there of) for online fraud howsoever caused. Please see our privacy notice.

Cancellation of Order

Except in special circumstances and then only by written agreement; Sherwood Models will not accept any cancellation of order within 28 days of it being originally placed. Sherwood Models shall be entitled at its discretion to cancel or suspend performance of the contract. This will depend upon the the prevailing situation at the time of order. Sherwood Models shall not be obliged to give a reason for doing so to the customer.

TERMS OF TRADE POLICY STATEMENT

Placing an order on or off line constitutes acceptance and compliance of the above terms of trade governed by the Law of England. If any part of these terms/conditions shall be found to be unlawful it shall not affect the validity or enforceability of the remaining terms/conditions.
